Two Authorities Jointly Release Typical Cases on Punishing Crimes of Healthcare Security Fraud

Recently, the Supreme People's Procuratorate (SPP) and the National Healthcare Security Administration (NHSA) have jointly issued the Circular on Issuing Typical Cases on Punishing Crimes of Healthcare Security Fraud in Accordance with the Law to Ensure the Security of Healthcare Security Funds (the "Circular").

The Circular selects six typical cases, including the fraud case involving Li X. et al.; the case involving Chen X. et al. for fraud and concealing and withholding criminal proceeds; the fraud case involving Yi X. et al.; the case involving Chai X. et al. for fraud, concealing and withholding criminal proceeds, and other offenses; the fraud case involving Qin X. and Zhang X.; and the fraud case involving Zhang X. et al. These cases involve such criminal conduct as healthcare security fraud committed by personnel of designated medical institutions, fraud involving the resale of medicines originally dispensed under healthcare security coverage back into the distribution chain, fraud committed by personnel of specialized medical institutions through falsified or fictitious diagnosis and treatment items, fraud committed by professional fraudsters, and fraudulent claims for maternity allowances based on fictitious employment relationships. The amounts involved range from more than CNY 1 million to more than CNY 10 million. The cases cover key areas and emerging methods associated with frequent healthcare security fraud crimes and are highly representative and typical.
