CAAC Again Seeks Comments on the Rules for the Operation Certification of Small Commercial Transport Operators

Recently, the Civil Aviation Administration of China (CAAC) has released the Rules for the Operation Certification of Small Commercial Transport Operators (Draft for Comment) (the "Draft") and is again soliciting comments from relevant entities. The deadline for submitting comments is August 30, 2026.

The Draft covers general provisions, general rules on operating certificate holders, operations of small aircraft, commercial passenger or cargo operations using transport airplanes, aircraft and equipment, legal liability, and supplementary provisions. According to the Draft, applications for, issuance of, and administration of operating certificates and their operations specifications shall comply with the relevant requirements of the Provisions on General Aviation Operating Licensing Procedures. Upon obtaining an operating certificate and its operations specifications, a small commercial transport operator becomes a holder of a small commercial transport operating certificate under the Rules. The Draft further provides that certificate holders shall ensure that their employees are familiar with the laws, regulations, and procedures of the countries or regions in which operations are conducted outside China and that they are required to comply with. Certificate holders shall also establish a safety management system and be capable of implementing safety management in accordance with the Rules.
