Two Authorities Jointly Issue Standards for Online Product Testing and Evaluation Activities

Recently, the Cyberspace Administration of China (CAC) and the State Administration for Market Regulation (SAMR) have issued the Standards for Online Product Testing and Evaluation Activities (the "Standards").

The Standards clarify that entities engaged in online product testing and evaluation activities shall comply with laws, administrative regulations, and relevant provisions of the State, adhere to business ethics and public order and good morals, and follow the principles of objectivity, impartiality, comprehensiveness, and accuracy. The Standards require that, where online product testing and evaluation activities involve testing product functions, performance, or other items, such testing shall be entrusted to inspection and testing institutions holding the relevant statutory qualification accreditation and conducted in accordance with applicable standards and technical specifications. Where inspection and testing are conducted for food products, the testing party shall possess the corresponding qualifications, shall not use non-standard testing methods, and shall not evaluate items for which no nationally recognized testing methods exist. Different standards or methods shall not be used to conduct horizontal or vertical comparisons of similar products. The Standards further provide that, where a product is evaluated solely on the basis of subjective experience without testing, an explanatory statement shall be made. Website platforms shall strengthen the management of information content relating to online product testing and evaluation activities and promptly handle relevant complaints and reports.
