Recently, the Ministry of Natural Resources (MNR) and the Ministry of Housing and Urban-Rural Development (MOHURD) have jointly issued the Circular on Several Measures to Further Support Urban Renewal Initiatives (the "Circular").
The Circular introduces measures including enhancing the adaptability of detailed planning, optimizing transitional support policies, advancing the temporary use of existing land and space, and encouraging bundled supply and integrated operation of resources and assets. The Circular clarifies the working approach for conducting evaluation and optimization of detailed plans for urban renewal areas based on the "one map" framework, providing planning permits in accordance with the law, and promptly offering planning bases for the implementation of urban renewal initiatives. It also encourages local governments to formulate positive lists and regulatory requirements for mixed land development and composite space utilization, and to develop lists of planning permit exemptions for micro-renewal projects such as improvements to community public service facilities. In addition, the Circular provides that where existing land and housing resources are utilized to develop industries and sectors supported by the State, the original fixed transitional policy of maintaining the same land-use entity and planning conditions for five years shall be adjusted to a flexible transitional policy with five years as the general principle. The Circular further proposes that, when handling procedures for paid land use upon the expiration of the transitional period, support shall be given to newly added leasing-based transfer methods.
