Recently, the Ministry of Emergency Management (MEM) has drafted and released the Regulations on the Identification and Control of Hidden Hazards of Work Safety Accidents (Draft for Comment) (the "Draft") for public comments, while simultaneously seeking comments on the Draft's potential impact on fair competition. Comments on issues relating to fair competition must be submitted by January 25, 2026, and other comments must be submitted by February 17, 2026.
The Draft mainly provides for the strengthening of the comprehensive control of hidden hazards of accidents; the primary responsibilities of production and business operation entities; and supervision and regulation of the identification and control of hidden hazards of accidents. In particular, the Draft emphasizes the leading role of key responsible persons, such as principal persons in charge, in fulfilling their responsibilities, and clearly specifies the respective responsibilities of the principal persons in charge of production and business operation entities, various responsible persons in charge, functional departments, and grassroots production and operation units with respect to the identification and control of hidden hazards of accidents. In addition, the Draft provides that production and business operation entities shall establish and improve incentive mechanisms for the identification and control of hidden hazards of accidents, encourage employees to proactively identify and report such hidden hazards, and participate in eliminating hidden hazards of accidents in accordance with their job responsibilities.
