State Council to Revise Regulations of the People's Republic of China on International Maritime Transportation

The State Council has recently distributed the Decision on Revising the Regulations of the People's Republic of China on International Maritime Transportation (the "Decision"), effective from the date of promulgation.

The Decision mainly involves: (1) incorporating services provided by international shipping trading platforms into the scope of application; and (2) specifying that, where a country or region that has concluded or jointly participated in international maritime treaties or agreements with China violates the provisions of such treaties or agreements, thereby depriving or impairing the benefits to which China is entitled under such treaties or agreements, or hindering the realization of the objectives thereof, the Chinese government has the right to request the government of the relevant country or region to cease the above-mentioned conduct, take appropriate remedial measures, and may, in accordance with the relevant treaties or agreements, suspend or terminate the performance of the corresponding obligations; and where any country or region adopts, assists in adopting, or supports any discriminatory prohibitive, restrictive, or other similar measures against Chinese operators of international maritime transportation and their ancillary services, vessels, or crew members, the Chinese government may, take necessary countermeasures in light of the actual circumstances, except where sufficient and effective relief can be obtained under the relevant treaties or agreements.
