SPC Clarfies Matters on Jurisdiction of Primary People's Courts over First-instance Civil and Administrative Cases Involving IP

The Supreme People's Court (SPC) has released the Circular on Relevant Matters Concerning the Jurisdiction of Primary People's Courts over First-instance Civil and Administrative Cases Involving Intellectual Property (the "Circular"), effective from October 1, 2025.

The Circular adjusts the primary people's courts with jurisdiction over civil and administrative cases involving intellectual property, as well as their respective jurisdictional regions. For example, in Tianjin Municipality, for civil cases with a subject matter value below CNY5 million, the Primary People's Court of Nankai District of Tianjin Municipality has been newly designated to exercise jurisdiction, with jurisdictional coverage limited to Nankai District. According to the Circular, the Circular of the Supreme People's Court on Issuing the Criteria for the Jurisdiction of the Primary People's Courts over Intellectual Property-related Civil and Administrative Cases of First Instance will be repealed simultaneously. Cases already accepted prior to the implementation shall still be handled pursuant to the original rules.
