SAMR to Strengthen Safety Responsibility Management for Online Food Trading Platforms and Related Enterprises

Recently, the State Administration for Market Regulation (SAMR) has drafted the Provisions on Supervision and Regulation of the Fulfillment of Primary Food Safety Responsibilities by Third-party Online Food Trading Platforms and Online Food Sales Enterprises (Draft for Comment) (the "Draft"), which is now open for public consultation until September 11, 2025.

The Draft covers five key areas: (1) general requirements, including purpose, legal basis, and scope of application; (2) division of responsibilities and staffing requirements, specifying the allocation of responsibilities among platform enterprises and their branches, agents, partners, as well as online food sales enterprises, along with requirements for food safety management personnel and their competencies; (3) job responsibilities of personnel, specifying responsibilities of food safety directors and food safety officers within platform enterprises regarding online food safety management; (4) operational mechanisms for online food safety risk control, including platform enterprises' work systems such as daily control, weekly inspections, and monthly coordination, alongside regulatory measures for food safety personnel's fulfillment of responsibilities, training, and assessment requirements; and (5) clarification of legal liability and key definitions.
