SPC Issues Document to Implement the Private Sector Promotion Law

Recently, the Supreme People's Court (SPC) has issued the Guiding Opinions on the Implementation of the Private Sector Promotion Law of the People's Republic of China (the "Opinions").

The Opinions set forth 25 measures to thoroughly implement the Private Sector Promotion Law of the People's Republic of China and promote the healthy development of the private sector, covering five key aspects: overall requirements; treating enterprises equally according to law; guiding law-abiding and standardized business operations; ensuring strict and fair judicial practices; and improving the fair judicial system and mechanisms. Notably, the Opinions emphasize punishing crimes such as internal corruption within private-sector organizations through issuance of judicial interpretations, release of typical cases, research and guidance, and case trials. They aim to guide private-sector organizations to standardize internal governance, operate with integrity and in compliance with the law, regulate labor practices, and protect consumers' lawful rights and interests. The Opinions also promote further development of the private sector and support safeguarding private enterprises' safe "going global." Additionally, the Opinions clarify the need to improve mechanisms for punishing dishonest behavior and restoring credit, rigorously carry out special judicial actions to regulate enterprise-related enforcement, effectively address irregular enforcement actions, and minimize adverse impacts on their normal business operations.
