The State Administration for Market Regulation (SAMR) has recently issued the Announcement on Converting the Pilot Delegation into Formal Delegation for the Anti-Monopoly Review of Certain Concentrations of Undertakings (the "Announcement").
According to the Announcement, beginning August 1, the pilot delegation program will be converted into a formal delegation. Based on operational needs, certain cases of concentrations of undertakings eligible for the simplified procedure may be delegated to the provincial-level market regulatory authorities of five provinces/municipalities – Beijing, Shanghai, Guangdong, Chongqing, and Shaanxi – for review. The Announcement specifies that cases eligible for the simplified procedure may be delegated for review to the aforementioned authorities if they meet criteria such as "at least one declaring party is domiciled in a region under the jurisdiction of the delegated provincial-level market regulatory authority." The Announcement also sets out the procedures for the delegated review.
