The China National Intellectual Property Administration (CNIPA) recently drafted the Implementation Measures for Promoting the Development of the Private Economy through Intellectual Property (Draft for Comment) (the "Draft"), which are hereby released for public consultation by August 5, 2025.
The Draft comprises 21 articles in eight chapters and primarily covers four areas, namely, intellectual property (IP) creation, protection, utilization, and public services. Regarding IP protection, the Draft calls for strengthening the protection of innovation achievements of private economic entities and their operators, lawfully investigating and punishing infringements on exclusive trademark rights and patent rights, and other violations, leveraging the role of national IP protection centers to enhance rapid and coordinated IP protection, expanding diversified channels for resolving IP disputes involving private economic entities, and strengthening the foreign-related IP protection, and enhancing the capabilities in early warning and prevention of foreign-related IP risks.
