The National Health Commission (NHC) has recently released the Administrative Measures for Medical Supervision (Draft for Comment) (the "Draft") and is now soliciting public feedback. The deadline for submitting comments is August 18, 2025.
The Draft consists of general provisions, medical administrative law enforcement, supervision of medical administrative law enforcement, safeguard measures, legal liability, and supplementary provisions. The section on medical administrative law enforcement outlines enforcement procedures, enforcement scope, enforcement measures, flexible enforcement, inter-agency collaboration, work coordination, and the fulfillment of responsibilities by practicing entities. The section on the supervision of medical administrative law enforcement covers the enforcement accountability system, routine supervision of law enforcement, case reviews, special supervisory actions, supervision mechanisms for enforcement cases, and the reporting of enforcement information. According to the Draft, individuals who refuse or obstruct lawful supervision, inspections, or investigations conducted by medical administrative law enforcement officers, disrupt their normal work or personal life, or endanger their personal safety or dignity through insults, defamation, threats, or assault, and whose acts are suspected of violating public security regulations or constituting a crime, shall be referred to the public security and other relevant authorities.
