MEE Invites Input on Administrative Measures for the Compensation for Marine Ecological and Environmental Damage

The Ministry of Ecology and Environment (MEE) has recently formulated and released the Administrative Measures for the Compensation for Marine Ecological and Environmental Damage (for Trial Implementation) (Draft for Comment) (the "Draft") and is now seeking public input. The cut-off date for receiving comments is August 1, 2025.

The Draft, intended to be issued as a departmental normative document, consists of seven chapters and 27 articles, including general provisions, initiation of claims, damage investigation, negotiation and litigation, ecological and environmental restoration, miscellaneous, and supplementary provisions. The Draft stipulates that, in cases where it is possible directly determine whether to initiate a claim, the claim shall be initiated promptly. For cases requiring a preliminary review to determine whether to initiate a claim, the Draft specifies the scope and timeframe of such a review. To avoid duplicate claims, it outlines five scenarios in which the claim process shall be terminated, such as full discharge of compensation obligations, final judicial rulings, and full ecological restoration. Additionally, the Draft clarifies the restoration objectives and requirements for various scenarios and establishes the conditions under which restoration may be carried out in advance.
