Three Authorities Fully Promote the Use of Special Credit Reports in Lieu of Certificates of No Record of Legal or Regulatory Violations

Recently, the National Development and Reform Commission (NDRC) and two other authorities have issued the Circular on Fully Promoting the Use of Special Credit Reports in Lieu of Certificates of No Record of Legal or Regulatory Violations (the "Circular").

The Circular sets out measures in six aspects, including strengthening the data foundation for special credit reports, clarifying applicable entities and scope of application, facilitating access to special credit reports, and establishing mechanisms for cross-provincial mutual recognition of such reports. According to the Circular, the replacement of certificates with special credit reports ("credit report in lieu of certificate") applies to various market entities including enterprises, individual businesses, and farmers' cooperatives, while eligible localities are encouraged to extend its application to social organizations and natural persons. The Circular also requires provincial-level lead departments for credit affairs to actively expand the application scope of special credit reports, broaden their use scenarios in accordance with laws and regulations, and promote the use of "credit report in lieu of certificate" in matters such as administrative approvals, bidding and tendering, corporate financing, and applications for preferential policies.
