The National Development and Reform Commission (NDRC) and two other departments have jointly issued the Negative List for Market Access (2025 Edition) (the "List"), with effect from the date of issuance.
The revisions to the List adhere to the principle of "resolutely removing what should be removed and reasonably adding what should be added", fully reflecting the formulation, revision, repeal, and interpretation of laws and regulations, as well as the outcomes of the administrative approval system reform in recent years. The number of items has been reduced from 117 in the 2022 edition to 106; the number of nationwide specific management measures under these items has been reduced from 486 to 469; and the number of local management measures has been reduced from 36 to 20. There are two highlights in these revisions. On the one hand, they lower market access thresholds and stimulate market vitality, as evidenced by the actions to directly cut the number of nationwide measures, partially relax some nationwide measures, and lift certain local measures. On the other hand, they focus on lawful market access in key areas and ensure a solid bottom line for safety, by incorporating regulatory measures for new business forms and emerging industries and strengthening risk prevention and control in key areas.
