Recently, the China National Intellectual Property Administration (CNIPA) has issued the Circular on Launching the Application and Recognition for National Industrial Intellectual Property Operation Centers (the "Circular").
According to the Circular, entities applying to establish a national industrial intellectual property (IP) operation center must meet the basic requirements set out in Chapter III of the Guidelines for the Development and Management of Industrial Intellectual Property Operation Centers (Interim) (the "Guidelines"). The relevant procedures include application, recommendation, and recognition. The construction entity, as the applicant, must submit its application to the provincial IP office where it is located, in accordance with the relevant provisions of the Guidelines. Provincial IP offices may request additional supporting materials based on local requirements. For central enterprises as applicants, applications may be submitted directly to CNIPA by their headquarters, with a copy filed with the relevant provincial IP office. The Circular also specifies that CNIPA will review and screen the application materials submitted by local authorities and central enterprises, organize expert evaluations, and publish a list of proposed recognition candidates for public notice. After the public notice period concludes without objections, the official recognition will be granted.
