Recently, the General Administration of Customs (GAC) has revised and formulated the Administrative Measures of the Customs of the People's Republic of China for Inspection and Supervision of Import and Export of Cosmetics (Draft for Comment) (the "Draft"), which is now open for public feedback until June 22, 2024.
The Draft introduces several key revisions: (1) ensuring full compliance with superior laws; (2) consolidating the achievements made in the reform to streamline administration, delegate powers, and improve services, and continuously optimizing the business environment at ports; (3) tightening the comprehensive oversight of the import of cosmetics and refining the supervision process; (4) optimizing the cosmetics export management to establish a closed-loop supervision system; and (5) reflecting a forward-looking perspective and reserving space for reform and development. By streamlining the entire process and procedures for supervision of import of cosmetics, the Draft specifies the process and key points of each stage of supervision, outlining measures in three key areas: first, strengthening the primary responsibility of enterprises, mandating clear responsibilities, such as importer reviews of imported cosmetics and truthful recording of information related to imported cosmetics; second, conducting conformity assessments for imported cosmetics; and third, advancing the concept of risk management, facilitating the imposition and lifting of control measures, and establishing a closed-loop supervision system.
