Recently, the Ministry of Natural Resources (MNR) has issued the Decision on the Sixth Batch of Amended Departmental Rules (the "Decision"), with effect on the date of issuance.
According to the Decision, this amendment mainly involves relevant provisions in two departmental rules: the Implementing Rules of the Interim Regulations on Real Estate Registration (Revised in 2019) (the "Rules") and the Interim Measures for Inquiry of Real Estate Registration Data (Revised in 2019) (the "Measures"). There are four key modifications to the Rules. These include the addition of provisions pertaining to online application for real estate registration, as explicitly stated in Paragraph 3 of Article 9: "For online applications for real estate registration via the internet, real-name authentication shall be conducted through an identity authentication system that complies with national regulations. If an applicant submits electronic materials, paper materials are no longer required." Regarding the Measures, this amendment clarifies the legal effect of electronic inquiry result certificates for real estate registration data. Paragraph 2 of Article 10 is revised to read "an inquiry result certificate shall indicate the date of issuance and bear the dedicated seal of the real estate registration institution for inquiries. Electronic inquiry result certificates have the same legal effect as their paper counterparts."
