Recently, the State Administration for Market Regulation (SAMR) released the Administrative Measures for Adoption of International Standards (Draft for Comment) (the "Draft"), which is now open for public comments until June 8, 2024.
The main revisions in the Draft include: (1) redefining the scope of adoptable international standards and the scope of organizations involved in standards adoption; (2) clarifying the requirements for the whole process management of adopting international standards; and (3) strengthening compliance with intellectual property rights policies. Specifically, the Draft clearly stipulates that the adoptable international standards are those developed and published by ISO, IEC and ITU. When developing national standards, priority should be given to adopting international standards based on national conditions. The development of national standards that adopt international standards should first meet the requirements of national standards development procedures, and also meet the specific requirements of the development process. These include requirements for pre-search work on international standards such as dynamic tracking, applicability analysis, and verification; enhancing requirements for assessment, drafting, review, and other stages of work; proposing additional requirements for conducting statistics on the national standards that adopt international standards; and shortening the timeline for developing national standards that adopt international standards.
