Recently, the Supreme People's Procuratorate (SPP) and All-China Federation of Trade Unions (ACFTU) have jointly released the Circular on Issuing the Typical Cases of Leveraging the Function of Administrative Procuratorial Supervision to Tackle the Root Causes of Wage Arrears (the "Circular").
The Circular states that this batch of typical cases includes "an administrative non-litigation enforcement supervisory case involving labor wage arrears by a Shanghai catering company" and three other cases. The aim is to carry out the special campaign against wage arrears and to implement the "One Letter and Supervision Opinion & Recommendation" system, and lawfully promote the resolution of the wage arrears issues for workers. According to the Circular, these four typical cases focus on supervising administrative non-litigation enforcement, particularly in sectors where wage arrears are common like construction and services. They target urgent and difficult issues such as enterprises maliciously deregistering to avoid paying workers inadequately and difficulties in enforcement, aiming to address the wage arrears to workers at their core.
