Recently, the Supreme People's Procuratorate (SPP) has released the Circular on Issuing Typical Prosecution Cases of Public Interest Litigation to Support the Prevention and Control of Noise Pollution (the "Circular").
The Circular includes four typical cases, one of which is the "Administrative Public Interest Litigation Case Handled by the People's Procuratorate of Yiwu City, Zhejiang Province, Urging the Rectification of Noise Pollution Caused by Boom Motor Vehicles," provided for reference purposes. According to the Circular, these typical cases, totaling four, involve noise pollution issues related to transportation, construction, and social life. They have the following features: firstly, focusing on addressing the hot and challenging issues in noise pollution prevention and control, addressing public concerns. Secondly, emphasizing the use of modern technology and expert resources to solve investigation and evidence collection challenges. Thirdly, accurately applying the law to urge pollution prevention and control entities to fulfill their rectification responsibilities. Lastly, combining preventive measures and early intervention to promote systematic governance and source control of noise pollution.
