Two Authorities Launch the National Pilot Program for Standardizing Administrative Adjudications on Patent Infringement Disputes at City and County Levels
Recently, the China National Intellectual Property Administration (CNIPA) and the Ministry of Justice (MOJ) have issued the Official Reply on the National Pilot Program for Standardizing Administrative Adjudications on Patent Infringement Disputes at City and County Levels (the "Reply").
The Reply grants approval for the national pilot program for standardizing administrative adjudications on patent infringement disputes at city and county levels in provinces including Jiangsu. The pilot program, running from January 2024 to December 2025, will be implemented in 31 cities, including Nanjing City of Jiangsu Province, and 55 counties (cities, districts), including Yixing City of Jiangsu Province, aiming to standardize the administrative adjudications on patent infringement disputes at city and county levels. The Reply emphasizes the need for each pilot area to develop specific implementation plans and ensure their effective implementation. Intellectual property bureaus and judicial departments in relevant provinces are required to establish acceptance and evaluation criteria for the pilot program, conduct midterm evaluations for the pilot areas in due time, and strictly organize acceptance inspections based on the criteria upon completion. The acceptance results from the pilot areas should be promptly submitted to the CNIPA and the MOJ for approval, and a summary of the pilot work should be submitted within two months of the approval.
