Recently, the State Administration for Market Regulation (SAMR) has released the Circular on Studying, Promoting, and Implementing the Implementing Regulations on the Law of the People's Republic of China on the Protection of Consumer Rights and Interests (the "Circular").
The Circular emphasizes actions in four areas, including understanding the significance of the introduction of the Implementing Regulations on the Law of the People's Republic of China on the Protection of Consumer Rights and Interests (the "Regulations"), and conducting the studying and promotion activities. The Circular states that the Regulations cover various areas of market regulation, including credit, anti-monopoly, pricing, anti-unfair competition, online trading, contracts, advertising, product quality, etc., making it a basic regulation for the system. Market regulatory authorities are tasked with making the studying of the Regulations a priority, conducting training through various channels to reach every relevant department, market regulatory office, and grassroots cadre, thereby enhancing the system's capability to protect consumers' legitimate rights and interests. The Circular also calls for improving institutional supply, timely amending, abolishing, and interpreting relevant documents and policies; strengthening inter-departmental cooperation to facilitate the holistic implementation of the Regulations; and promoting systematic governance to enhance the sense of gain of the public.
