Recently, the Ministry of Transport (MOT) has released the Rules of Operations Certifications for Public Air Transport Carriers with Large Aircraft (the "Rules"), which take effect from the date of release.
Compared to the previous edition, the Rules not only transform new changes in the Annexes to the Convention on International Civil Aviation into domestic rules and regulations but also streamline and improve the management policies and standards for the safety management system, flight operation management system, continuous airworthiness management system, and personnel qualification management system of air transport companies, in accordance with the Work Safety Law of the People's Republic of China (2021 Amendment). Specifically, in terms of the safety management system of air transport companies, the Rules (1) increase responsibilities and qualification requirements for the persons in charge of enterprises; (2) clarify the definition of flight data analysis programs and the basic principles of their implementation, strictly regulate the use and scope of application of data such as FDR by air transport companies, strengthen the rational use of various safety and operation data, and emphasize the importance of implementing flight data analysis programs; and (3) improve the content and standards of operations certification.
