Recently, the Supreme People's Court (SPC) has released the Opinions on Launching the "Care for Minors Reminders" Campaign in Divorce Cases Involving Minors (the "Opinions").
The Opinions aim to guide the parties in divorce cases to strike a balance between marital freedom and maintaining family stability, show concern and care for minors, and prioritize their physical and emotional needs for healthy growth. The Opinions stress the importance of parties in divorce cases recognizing their responsibility, fulfilling their guardianship duties according to law, and fully protecting the legitimate rights and interests of minors. This includes handling matters such as child support, visitation rights, and property partition in a manner that safeguards the healthy growth of minors. Preventing juvenile delinquency is the primary goal and task of the Opinions. Furthermore, the Opinions highlight the value of using case examples, advocate for courts to implement the "Care for Minors Reminders" campaign based on real cases, through which courts should effectively communicate to parties in divorce cases their legal obligations and rights of parents concerning minors, as well as the adverse consequences of violating the law. The Opinions also empower local courts to tailor the specific content of the "reminders" according to their actual circumstances.
